Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records in the impugned order in Tha.Va.No.02/09-10.Sa.Pa dated 11.09.2009 passed by the 3rd respondent and quash the same as illegal and consequently direct the 2nd respondent to cancel the auction proceedings in Ni.Ma.No.59/2010-2011 dated 26.08.2010 of petitioner's agricultural land comprised in S.Nos.174/8, 200/6B, 202/3 and 200/1 to an total extent of 1 acre 06 cents situated at Mushtakurichi Village, Aruppukottai Taluk, Virudhunagar District dated 09.10.2025 and to initiate the proceedings immediately and adjudicate the matter within a time frame.

ORDER

This writ petition is filed for the following relief : "to call for the records in the impugned order in Tha.Va.No.02/09-10.Sa.Pa dated 11.09.2009 passed by the 3rd respondent and quash the same as illegal and consequently direct the 2nd respondent to cancel the auction proceedings in Ni.Ma.No.59/2010-2011 dated 26.08.2010 of petitioner's agricultural land comprised in S.Nos.174/8, 200/6B, 202/3 and 200/1 to an total extent of 1 acre 06 cents situated at

Mushtakurichi Village, Aruppukottai Taluk, Virudhunagar District dated 09.10.2025 and to initiate the proceedings immediately and adjudicate the matter within a time frame."

2. This Court has convinced the respondents to receive the outstanding amount at the rate of 7.5%. The total amount payable would come to Rs.2,75,833/-. The petitioner undertakes to pay the first instalment on or before 25.10.2025. The remaining amount shall be paid in three equated monthly instalments on or before 10th of succeeding month. The first of which will fall due on 10.11.2025. It is made further clear that if there is any default in the payment, the entire amount as claimed will fall due.

3. This Writ Petition is disposed of on the above terms. No costs. Consequently, connected Miscellaneous Petitions are closed. 16.10.2025 NCC : Yes/No Index : Yes/No Internet : Yes gbg
