Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents to consider petitioner's representation dated 27.11.2023 and re-convey the property to the petitioner association that was gifted to the Government vide Doc.No.2652/2020 in respect of Survey No.302/2 situated in Keelakarai Revenue Village, Keelakarai Taluk, Ramanathapuram District measuring to an extent of 20 cents in order to construct a water tank for public usage within the time stipulated by this Court. ORDER
This writ petition is filed for the following relief: "To direct the respondents to consider petitioner's representation dated 27.11.2023 and re-convey the property to the petitioner association that was gifted to the Government vide Doc.No.2652/2020 in respect of Survey No.302/2 situated in Keelakarai Revenue Village, Keelakarai Taluk, Ramanathapuram District measuring to an extent of 20 cents in order to construct a water tank for public usage."

The subject property was gifted to the Government vide Doc.No.2652 of 2020 dated 14.10.2020 by the petitioner Association for construction of water tank which is situated in the premises of Marriage Hall. The respondents started the work for building the water tank by putting up a compound wall. Since the same caused inconvenience to the users of the marriage hall, the petitioner Association submitted a representation to the 2nd respondent seeking re-conveyance of the gifted land and further stated that the petitioner is willing to gift an alternative site for the construction of the water tank. The 1st respondent vide proceedings dated 06.05.2022, directed the 2nd and 3rd respondents to take action on the petitioner's representation, but to no avail. While so, the Municipal Corporation had passed a resolution dated 14.07.
2022 to change the location of the water tank to a different place. Pursuant to the same, the petitioner sent another representation dated 09.09.2022 to the 1st and 2nd respondents to take further action. Since the same was not considered, the petitioner preferred another representation dated 27.11.2023. The 1st respondent has sent a communication dated 18.01.
same. Thereafter, no further action has been taken. Therefore, the petitioner is before this Court.
3. Heard the learned counsels on either side.
4. Without going into the merits of the case, this Court directs the 4th respondent to consider the petitioner's representation, dated 27.11.2023 and pass orders, in accordance with law, after giving an opportunity of personal hearing to the petitioner, within a period of two
(2) months from the date of receipt of copy of this order.
5. With the above direction, this Writ Petition stands disposed of. No costs.
