ORDER

Heard both sides.

2.The petitioner is the purchaser. Sale deed dated 16.09.2025 was executed in favour of the writ petitioner. It was presented for registration. The second respondent has kept the document as pending document. Hence, this writ petition has been filed to direct the second respondent to register and release the document. 3.When matter was taken up for hearing, the learned Special Government Pleader submitted that the property is located in Nagercoil Town and therefore, it cannot be considered as an agricultural land. 4.If that be so, it is a matter of valuation. Registration cannot be refused on that ground. The second respondent is directed to register the document. If the second respondent is of the view that the document has been undervalued, it is open to the second respondent to make a reference under Section 47A of the Indian Stamp Act. It is well settled that till the reference is decided, the document cannot be released. All 2/4

the contentions of the writ petitioner regarding valuation and the character of the land are left open. That issue has not been gone into in this writ petition.

5.With a limited direction to register the document and by granting liberty to the second respondent to refer the matter under Section 47A of the Indian Stamp Act, this writ petition is partly allowed. No costs. 15.10.2025 NCC : Yes/No Index : Yes / No Internet : Yes/ No ias To:
