This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to call for the records relating to the order Page No. 2 of 6

passed by the third respondent/Tahsildar, Kariapatti Taluk, Virudhunagar District, dated 13.09.2025, uploaded on the online portal on the same date, in response to the petitioner's Application No.2025/0105/26/473824 and to quash the same as illegal and consequently direct the third respondent to issue patta in the petitioner's name in respect of the property comprised in Survey No.135/6B, S.Maraikulam Village, Kariapatti Taluk, Virudhunagar District and further direct the first to third respondents to suitably rectify the FMB sketch relating to the said land in consonance with the patta and update the same in the online revenue records.

2. By the impugned order dated 13.09.2025, the petitioner's application dated 13.08.2025 seeking transfer of patta by surveying the property in question and subdividing the same was rejected. It is not in dispute that the survey could not be conducted on account of the presence of thorny bushes at the said place.

3. The learned counsel appearing for the petitioner would submit that the petitioner is ready to clear the thorny bushes within a week's time. Page No. 3 of 6

The learned Additional Government Pleader appearing for the first to fourth respondents would submit that since there were thorny bushes, the application was rejected and that if the petitioner makes a fresh application and clears the thorny bushes, the same will be considered on merits and in accordance with law.

Recording the said submission, this Writ Petition is disposed of with a direction to the third and fourth respondents to conduct a survey of the land in the event of the petitioner filing a fresh application and clearing the thorny bushes and to conclude the same within a period of twelve weeks from the date of receipt of such application. It is needless to state that the claims of all parties shall be considered and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923 and that in the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. It is also needless to state that before conducting the survey, notice shall be issued to the adjacent landowners and other interested parties, if any and that if required, police assistance may be sought. The further request of the petitioner for subdivision of the land, Page No. 4 of 6

issuance of patta, rectification of the FMB sketch, etc., shall be considered thereafter in accordance with law. No costs. Consequently, the connected Miscellaneous Petitions are closed.
