PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to issue a direction to the third and fourth respondents to conduct further enquiry based on the petitioner's complaint dated Nil.06.2017 forwarded to them a communication letter vide C.No.160/AC Town Crime/2017 dated 16.08.2017 sent by the fifth respondent and based on the petitioner's representation dated 20.11.2023. For petitioner : Mr.V.Rajiv Rufus For Respondents : Mr.R.M.Anbunithi, Additional Public Prosecutor O RDER This petition has been filed seeking to direct the third and fourth respondents to conduct further enquiry based on the petitioner's complaint dated Nil.06.2017 forwarded to them a communication letter vide C.No.160/AC Town Crime/2017 dated 16.08.2017 sent by the fifth respondent and based on the petitioner's representation dated 20.11.2023. 2.

The learned Additional Public Prosecutor would submit that during the course of investigation, it was not found that the amount involved in this matter is above Rs.3 Crores. Therefore, as per the DGP circular, it has to be investigated by the concerned District Crime Branch and not by the Economic Offence Wing.

3.The third respondent shall make a preliminary enquiry as to the jurisdiction and if it is found that it falls below the amount prescribed by the DGP Circular, then it can transfer the same to the District Crime Branch, Tirunelveli, if not, it can proceed further. 4.With the above said directions, this criminal original petition stands disposed of.
