PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to instruct the 2nd respondent to conduct the survey, in survey No.1999/3, patta No.1559, to the extent of 565 squire fit in the Nagamapatti, Vedasandur Village, Vedasandur Taluk, Dindigul District and to fix a four boundary based on the petitioner online application dated 25.07.2025 and the representation dated 26.07.2025 and the same direct the 3rd respondent will provide suitable police protection at the time of survey for the smooth survey within a time frame that may be stipulated by this court.

ORDER

By relying on sale deed dated 21.10.2008 and patta No.1559 in the name of the Petitioner, the petitioner had applied online for the conduct of a survey on 25.07.2025. The present writ petition relates thereto. 2.Learned Additional Government Pleader accepts notice on behalf of respondents 1 and 2 and Mr.S.Prakash, learned Government Advocate(crl.side) accepts notice on behalf of respondent 3. Learned Additional Government Pleader submits that the petitioner's application would be acted upon within three months from the date of receipt of a copy of this order after issuing notice to owners of relevant adjacent lands.

3.From the affidavit in support of the writ petition, it appears that an adjacent land owner was disturbing the petitioner's peaceful enjoyment of the property. Therefore, it appears that objections are being raised in relation to 2/4

boundaries. Consequently, it is necessary to issue notice to relevant adjacent land owner before conducting a survey.

4.Subject to the above observations, this writ petition is disposed of by directing the first and second respondents to initiate action on the petitioner's application for survey after issuing notice to relevant adjacent land owners and considering objections, if any, from them. This process shall be completed within three months from the date of the receipt of a copy of this order. No costs.
