Government Pleader COMMON ORDER The petitioner in W.P.(MD) No.28261 of 2025 traced title from a sale deed dated 03.10.1960 bearing Document No.1509 of 1960 and claims ownership under subsequent sale deed dated 04.09.2025 bearing Document No.3046 of 2025. The relief claimed in the writ petition is for 2/6
a direction to consider grant of patta to the petitioner in respect of 83 cents in Survey No.421/1B7A. The relief claimed in W.P.(MD) No.25987 of 2025 is to direct the respondents therein to consider the representation of M.Nallasamy not to issue patta to R.Sibiraj (the petitoner in the other writ petition) in respect of Survey No.421/1B7A.
2. Learned Special Government Pleader appears for the respondents in both the writ petitions. He submits that a suit has been filed by A.J.Harishraj and P.Kavinraj challenging sale deeds which have a bearing on the relief claimed by R.Sibiraj.
3. In the typed set of papers filed by R.Sibiraj, Patta No.960 has been enclosed and the said patta has been issued to eight persons in respect of Survey No.421/1B7A. Therefore, unless the patta issued to the pattadhars in Patta No.960 is cancelled, the request of R.Sibiraj cannot be entertained.The jurisdiction to cancel such patta is vested with the Revenue Divisional Officer.
4. For reasons aforesaid, these writ petitions are disposed of on the following terms:

(i) R.Sibiraj is granted leave to approach the Revenue Divisional Officer for cancellation of Patta No.960. The said appeal shall be filed within two weeks from the date of receipt of a copy of this order. (ii) If received within such period, the Revenue Divisional Officer is directed to receive and dispose of the same on merits without going into the question of limitation after providing a reasonable opportunity to R.Sibiraj, M.Nallasamy and all the pattadhars in Patta No.960. A speaking order shall be issued within three months from the date of receipt of the appeal. No costs.
