ORDER

The present petition has been filed by the 4th accused in PRC.No.14 of 2018 on the file of the Judicial Magistrate No.II, Ramanathapuram seeking to quash the charge sheet wherein the petitioner is alleged to have committed offences under Sections 147, 148, 341, 294(b), 324, 307 and 149 I.P.C. 2.A perusal of Section 161(3) Cr.P.C statement of the doctor reveals that the victim was treated as an outpatient and a certificate has been issued by her that the victim had sustained simple injury. Therefore, it is clear that the provisions under Section 307 of I.P.C are not made out and only Section 326 of I.P.C gets attracted.

3.Pending trial, the parties have entered into a compromise wherein the defacto complainant has agreed for quashing of the charge sheet as against the 4th accused who is arrayed as petitioner herein. The defacto complainant is present today and he acknowledges the fact that he had agreed for quashing of the chare sheet as against the petitioner. 4.In view of the above said facts, the final report in PRC.No.14 of 2018 on the file of the Judicial Magistrate No.II, Ramanathapuram stands quashed as against the petitioner/accused No.4. This Criminal Original Petition is allowed. The compromise memo shall form part of this order. 02.04.2026.
