This Criminal Miscellaneous Petition is filed to suspend the sentence imposed by the learned Sessions Judge, Special Court for POCSO Act Cases, Dindigul in Spl.S.C.No.79 of 2023, dated 30.06.2023. This is 1/4

the second application filed for suspension of sentence. The earlier application filed by these petitioners in Crl.M.P.(MD)No.15875 of 2023 was dismissed by this Court as withdrawn by order dated 12.03.2025.

2. The case of the prosecution is that the appellants had sexual intercourse with the minor victim girl several times. Hence, the case.

3. This Court considered the rival submissions and also perused the materials placed before this Court.

4. On perusal of records, this Court is of the view that this is not a fit case for granting suspension of sentence. Hence, this Criminal Miscellaneous Petition is dismissed.

5. Typed set of papers in the main appeal is made ready. Registry is directed to list the appeal under the caption 'accused in jail cases' in the usual course.
