ORDER
This writ petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to consider the petitioner's legal heir certificate Application No.TN-7202508012167, dated 01.08.2025, within a stipulated time that may be fixed by this Court. 1/4
2. Ms.D.Farjana, Ghoushia, learned Special Government Pleader, takes notice for the respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3. According to the petitioner, his father died on 28.08.1980, leaving behind four legal heirs, and a death certificate was issued by the Trichy Municipality. His paternal grandmother, Kader Bi, and his greatgrandfather, Sheik Hussain, who was the son of Khaja Hussinudin, are stated in the register of Inam Village in Trichy East Taluk. Since the petitioner requires a legal heirship certificate to establish the correlation of the said predecessors in order to claim his ancestral property, he applied for the same before the respondent on 01.08.2025, along with a genealogy table. On 06.10.2025, he approached the respondent regarding the status of his application. However, there has been no response. Hence, he has filed the present writ petition.
4. The learned Special Government Pleader, appearing for the respondent, would submit that the application of the petitioner will be considered in accordance with law.
5. In view of the above, without expressing any opinion on the merits of the matter, the respondent is directed to dispose of the petitioner's application dated 01.08.2025 and pass final orders on its own merits, after 2/4
conducting an enquiry and after affording a reasonable opportunity to the petitioner, as well as the other interested parties if any, within a period of four months from the date of receipt of a copy of this order.
6. With the above directions, this writ petition stands allowed. No costs.
