Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus forbearing the respondents 4 and 5 or their agents or any other persons from continuing the religious endowed activities by the petitioner in S.Nos.643/1, 829/2, 832/2, 833, 835, 836 and 1564/4 to an extent of 4.95 acres, Tirunelveli Revenue Village, Town and Taluk and consequently to direct the second respondent to mutate the revenue records insofar as S.Nos.643/1, 829/2, 832/2, 833, 835 and 836 to the petitioner within the time stipulated by this Court.

ORDER

This Writ Petition has been filed to forbear the respondents 4 and 5 from disturbing the religious endowed activities carried on by the petitioner in S.Nos.643/1, 829/2, 832/2, 833, 835, 836 and 1564/4, to an extent of 4.95 acres, Tirunelveli Revenue Village, Town and Taluk and consequently to direct the second respondent to mutate the revenue records in S.Nos.643/1, 2/6

829/2, 832/2, 833, 835 and 836, Tirunelveli Revenue Village, Town and Taluk, in the name of the petitioner.

The learned counsel appearing for the petitioner would submit that the present Writ Petition has been filed to mutate the revenue records in the name of the petitioner insofar as the properties in S.Nos.643/1, 829/2, 832/2, 833, 835 and 836, Tirunelveli Revenue Village, Town and Taluk are concerned. He would further submit that due to the intervention of the respondents 4 and 5, revenue records have not been mutated in the name of the petitioner. According to the learned counsel, the petitioner / Kurukkuthurai Annathana Chathiram is providing Annadhanam to general public and the respondents 4 and 5 are interfering with the same. He therefore, prayed for allowing this Writ Petition.

Per contra, the learned Special Government Pleader appearing for the respondents 1 and 2 would submit that already the revenue records in respect of the above properties have been mutated in the name of the petitioner. To be noted, even before filing of this Writ Petition, the revenue records with regard to those properties stood in the name of the petitioner. He therefore would submit that nothing survives for further adjudication in this Writ Petition and prayed for dismissal of the same. 3/6

4. I have given due consideration to the submissions made on either sides.

As far as the first part of the prayer with regard to the intervention on the part of the respondents 4 and 5 is concerned, the petitioner is directed to approach the Civil Court to prevent those respondents from interfering with the Annadhanam activities carried out by them. With regard to the prayer of mutating the revenue records in the name of the petitioner is concerned, it is contended by the learned Special Government Pleader that the revenue records already stand in the name of the petitioner.

6. In view of the same, by recording the submissions of the learned Special Government Pleader, this Writ Petition is closed. No costs. Consequently, connected Miscellaneous Petition is closed. 15.12.2025 Speaking / Non-speaking order Index : Yes/No NCC : Yes/No mbi 4/6
