ORDER : The Court Made the following order :- The petitioner/A1, who is facing trial for the offences punishable under Sections 302 and 376 of IPC in S.C.No.50 of 2022 on the file of the learned Judicial 1/3

Magistrate Court, Aranthanki, in Crime No.30 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the deceased is the paternal aunt of the defacto complainant. On 19.01.2022, the petitioner along with other accused rapped the deceased namely Nagarethinam, aged about 65 years and caused several grievous injuries on her body. Thereby, caused death to her. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody from 23.01.2022. Hence, he prays for grant of bail to the petitioner. 4.The learned Additional Public Prosecutor for the State would submit that the bail petition filed by the co-accused in Crl.OP(MD)No.21702 of 2023 was dismissed by this Court, on 03.01.2024. Hence, he vehemently opposed to grant bail to the petitioner.

5.Heard the learned counsel on either side and perused the material records of the case.

6.Considering the above facts and circumstances of the case and also considering the gravity of the offence, this Court is not inclined to grant bail to the petitioner.
