ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus directing the 2nd respondent to complete the enquiry in Na.Ka.No.7399/18/A7 dated 6.10.2018 by considering section 23 of the Maintenance and welfare of parents and senior citizen act 2007 within a time stipulated by this Court.

2. Mrs.S.Jeya Priya, learned Government Advocate, takes notice for the respondents 1 and 2. Since no adverse order is going to be passed as against the respondents 3 and 4, notice to them is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, she is the mother of the respondents 3 and 4. However, they have not taken proper care of their parents. Hence, the petitioner approached the respondents 1 and 2. The second respondent initiated enquiry proceedings in Na.Ka.No.7399/18/A7 under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, and issued summons dated 06.10.2018 to the petitioner and the respondents 3 and 4. However, thereafter, there was no further progress. Hence, the petitioner made a representation to the second respondent on 31.10.2018. As there has been no action taken on the said representation, she has filed the present writ petition.

4. The learned Government Advocate, appearing for the respondents 1 and 2, would submit that the representation of the petitioner will be considered in accordance with law.

In view of the above, without expressing any opinion on the merits of the matter, the second respondent is directed to dispose of the petitioner's representation dated 31.10.2018 and pass final orders on its own merits, after affording a reasonable opportunity to the petitioner, as well as the respondents 3 and 4, within a period of one month from the date of receipt of a copy of this order.

6. With the above directions, this writ petition stands allowed. No costs.
