Heard Mr.R.Surya Prakash, learned Counsel for the Petitioner.

This petition has been filed to condone the delay of 154 days in filing the instant criminal revision case as against the judgment passed by the learned Principal Sessions Judge, Thanjavur in Crl.A.No.55 of 2023, dated 08.01.2025, confirming the conviction and sentence imposed by the learned Judicial Magistrate (Fast Track Court), Thanjavur in S.T.C.No.198 of 2018, dated 27.01.2023, thereby the Revision Petitioner was convicted for offence under Section 138 of Negotiable Instruments Act and sentenced to undergo 1 year simple imprisonment and to pay a compensation of Rs.7,00,000/- within one month to the Respondent and in default to undergo simple imprisonment for two months.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay is hereby condoned on condition that the Revision Petitioner shall pay a sum of Rs.1,000/- [Rupees One 2/6

Thousand only] to "Anbagam," an institution for mentally handicapped children, Race Course Road, Madurai - 625 002, having Account No. 1012101008800 in the name of "ANBAGAM," Canara Bank, Thallakulam Branch, IFSC Code: CNRB0001012, within ten days from today.

4. On receipt of such payment, Registry is directed to number the Criminal Revision Petition, if it is otherwise in order.

5. Mr.R.Surya Prakash, learned counsel for the Revision Petitioner, submits that the Revision Petitioner has already deposited 20% of the compensation amount before the Trial Court. He further submits that the Revision Petitioner is willing to deposit an additional 30% of the remaining compensation amount to the credit of S.T.C. No. 198 of 2018, dated 27.01.2023, on the file of the Judicial Magistrate (Fast Track Court), Thanjavur, and undertakes to produce the receipts for payment of the 20% and 30% amounts on the next date fixed. He prays 3/6

this Court to grant suspension of sentence and grant bail to the Revision Petitioner on such payment. The learned counsel for the petitioner prays to grant some time to deposit 30% of the remaining compensation amount, before the Trial Court.

Accordingly, after considering the submission made by the learned counsel for the Revision Petitioner that the Revision Petitioner is ready to deposit 30% of the remaining compensation amount to the credit of S.T.C. No. 198 of 2018, dated 27.01.2023, on the file of the Judicial Magistrate (Fast Track Court), Thanjavur, and the assurance given by the learned counsel that he will produce the receipts for both payments, this Court grants two weeks time to the Revision Petitioner to deposit 30% of the remaining compensation amount and to produce the receipts evidencing payment of 20% and 30% of the compensation amount, without fail.

7. List the Criminal Revision Petition on 19.11.2025 "for admission" and for consideration of the application for suspension of sentence and for grant of bail to the Revision Petitioner, before this Court.
