ORDER
(Order of the Court was made by the Hon'ble C.V.KARTHIKEYAN., J.) This petition has been filed by a mother expressing grievance that her daughter, who was aged 17 years at the time of filing this petition, had been missing on and from 06.10.2025. The daughter was studying B.A.E at a College 1/5
at Thiruchencode. She also impleaded the third respondent, whom she suspected had lured her daughter away from her natural place of residence.
2. Even when the matter came up for consideration before us on 24.10.2025, the detenue had been produced before us. Her date of birth is 17.10.2007 and she claimed that she married the third respondent at Trichy Vayalar Murugan Temple on 18.10.2025. The third respondent was also present in the court. However, the petitioner was not present. We therefore adjourned the matter today to enable the petitioner to have a conversation with her daughter/detenue.
3. Today the petitioner is present. The detenue/her daughter is also present. The third respondent is also present. We had referred the matter to the Mediation and Conciliation Centre. We acknowledged the efforts taken by Mr.T.Murugan, learned counsel, who had used his skills and had filed the following report:
''Both the parties present with their Counsels, basic principles of Mediation explained to them. The Detenue R.Brintha and her mother appeared before the Mediation. The respondent R3 S.Thilak present with his counsel. The detenue is a major, studying 1 B.Sc.(AI), subject respondent S.Thilak is a M.Com., degree holder working as a system operator in MRF Company and earning 2/5
Rs.20,000/- as monthly salary both of them belongs to different community but living in same village. The mother of the girl not accepted their marriage which held on 18/10/2025 at Trichy Vayalur Murugan Temple. Their marriage not registered. The Father of the respondent is a practicing advocate present and gave assurance to the safety of the girl, he full heartedly agree the marriage. I give enough advice to the couple and the parents of the couple. The fear of the Mother of the girl is that her daughter will discontinue the study the parent of the respondent and the respondent firmly answered that they will give full support to their married life particularly for the higher study of the girl. 1 adviced them to register the marriage as early as possible. The respondent also assured to support the higher study of the girl. Both the side counsels are very accommodative for the mediation. The WSSI Lalapettai also present and gave enough advice to the couple''.
4. The report had been signed by the petitioner, the detenue, the third respondent and also by the Mediator and also by the woman Special Sub Inspector of Police. The report is accepted. We therefore enquired with the petitioner and she had also reconciled to the subsequent compromise reached among the parties. The detenue is now handed over to the custody of the third respondent. We would only insist that the third respondent and his family members shall permit the detenue to continue with her education, as was agreed before the Mediator.
