The above petitions have been filed (i) to set aside the abatement caused due to the death of the sole respondent and (ii) to bring on record the proposed respondents 2 to 4 as legal representatives of the deceased sole respondent and rank them as respondents 2 to 4 in the above second appeal.

2. Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondents 2 to 4.

3. The petitioners filed a petition in CMP(MD)No.16653 of 2025 to condone the delay of 246 days in filing the petition for setting aside the abatement caused due to the death of the sole respondent and the said petition is allowed today.

4. Considering the above, these petitions are ordered and the Registry is directed to carry out necessary amendment in the main papers and post the main appeal on 09.02.2026.
