ORDER

[Order of the Court was made by RMT.TEEKAA RAMAN, J.] This Habeas Corpus Petition is filed to to direct the respondents 1 and 2 herein to take necessary steps to produce the person or body of the petitioner's daughter/detenue namely, A.Harshavardhini aged about 18 years before this Court and set her at liberty.

2.By an order dated 21.12.2023, the respondent police was directed to produce the absentee, Ms.A.Harshavardhini, who is the daughter of the petitioner herein. As it was represented by the learned Additional Public Prosecutor that the mother of the detenue has called over the police and produced the girl and hence, on the mention moved by the learned Additional Public Prosecutor, the case is listed today.

3.The abentee was produced before us and we had interaction and she expressed that her date of birth is 18.12.2005 and as an today, she is a major. From the interaction, we heard in the open Court, we find that due to some family quarrel between herself and her mother, the absentee left to the family friend at Vattalagunduand on information from the said family friend, her father came and picked up her from Vattalagundu and she also stated that though she knows the third respondent, he has not gone with her to Vattalagundu. The parents of the absentee also present before this Court and in order to identify the detenue, the parents of the absentee have also produced the Aadhaar Card viz., Aadhaar Card No.5916 6188 8793 and there is no dispute with regard to the identity of the girl produced before this Court.
