Criminal Original Petition is filed u/s 482 of cr.pc, to pass an order of direction to consider the bail application of the petitioners on merits in accordance with law on the same day in connection with Crime No.518/2023, dated 11/11/2023 on the file of the R1 and R2 by the Additional District and Sessions court for the Exclusive Trial of PCR Act cases, Sivagangai u/s SC/ST (prevention of atrocities) Act, 1989 of Sivagangai within a stipulated time that may be fixed by this court. ORDER:- This Criminal Miscelleneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru. S.Balasubramanian, Advocate for the Petitioner and of Thiru. B.Thaga Aravindh, Government Advocate for the respondents 1 &2, this Court made the following order:
The Petitioners herein seek extension of time to surrender before the Court of the Additional District and Sessions Judge, Special Court for Exclusive Trial of PCR Cases, Sivagangai. As per the order dated 21.11.2023, the Petitioners were directed to surrender before the Court concerned within fifteen days from the date of receipt of a copy of that order.
2.The learned Counsel for the Petitioners submitted that the first Petitioner had suffered injuries after met with an accident and therefore, he was unable to 2/4
appear before the Court within the stipulated time as per the earlier order. The learned Counsel for the Petitioners, therefore, seeks further time to surrender before the Court concerned.
3.Considering the facts and circumstances of the case and the submissions made by the learned Counsel for the Petitioners, one month time is granted to the Petitioners to surrender before the Court concerned and no further time will be granted.
4. Accordingly, this Petition is allowed.
