PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to reissue the passport of the petitioner's Passport Bearing No.Z7756319 on his File No.MD107601472952 by considering his representation dated 25.09.2025. ORDER

The present writ petition has been filed seeking a mandamus for the renewal of the passport of the petitioner based upon his application dated 25.09.2025.

The learned Government Advocate(crl.side) appearing for the second respondent submits that the petitioner has been implicated in a criminal case in Cr.No.317 of 2021 on the file of the second respondent which has culminated in filing of the charge sheet in S.C.No.42 of 2022 on the file of the learned IV Additional District and Sessions Judge, Madurai.

3. According to the learned counsel appearing for the writ petitioner, the trial has got stagnated for the past two years. He further submits that he had filed Crl.M.P.No.221 of 2021 before the trial Court and obtained orders for issuance of passport validity to the petitioner by way of an order dated 22.02.2024.

4. The learned Central Government Standing Counsel appearing for the first respondent submits that pursuant to the order of the trial Court, passport was renewed to the writ petitioner for a period of one year from 18.03.2024 to 2/5

17.03.2025. The passport has expired and an application to reissue the passport has been filed by the petitioner only on 25.09.2025. He further submits that since one year period has already expired, it is for the petitioner to approach the said Court again to get permission.

In view of the submission made by the learned Central Government Standing Counsel appearing for the first respondent, the petitioner is directed to approach the trial Court seeking no objection for travelling abroad. In case, if any application is filed, the same shall be disposed of by the trial Court within a period of four weeks. Based upon the order passed by the trial Court, the first respondent is directed to proceed in accordance with law.

6. With the above said observations, this writ petition stands disposed of. No costs.
