O R D E R

By relying on the pending final decree application in I.A.No.2 of 2023 in O.S.No.26 of 1956, after submitting a representation dated 10.10.2024, the petitioner seeks to restrain the grant of patta to any person in respect of land in survey Nos.627/1 and 627/27.

2. Learned Special Government Pleader accepts notice on behalf of all the respondents. By referring to the application for the final decree, he points out that the preliminary decree was issued on 29.03.1965. He also points out that the relief claimed by the petitioner is expansive and would have the effect of restraining the grant of patta to any person in respect of the properties described in the petition.

3. If an application for grant of patta is filed in relation to survey 2/4

Nos.627/1 and 627/27, it is always open to the petitioner to lodge objections in relation thereto before the Tahsildar concerned. Instead of doing so, the petitioner has sought to restrain the grant of patta to any person. In effect, if the relief claimed by the petitioner were to be granted, it would prevent the revenue officials from discharging their duties. Such relief cannot be granted by way of mandamus. Therefore, the present Writ Petition is dismissed by leaving it open to the petitioner to raise objections before the Tahsildar. No costs.
