PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents 1 and 2 to carry out survey, measurement and demarcation of boundaries of the Survey No.117/3 measuring to an extent of 0.20.5 Ares situated at Achampatti Village, Thanjavur Taluk, Thanjavur District with the aid of the 3rd respondent by considering the petitioner's application dated 14.08.2025.

ORDER

By asserting title over 50 and 1/2 cents in S.No.117/3 on the basis of sale deed dated 08.08.2013 and patta No.664, the petitioner had applied online for a survey on 17.01.2025. A subsequent application was presented on 14.08.2025 before filing the present writ petition.

2.Learned Government advocate accepts notice on behalf of respondents 1 and 2 and the learned Government Advocate(crl.side) accepts notice on behalf of the 3rd respondent. Learned Government Advocate points out that the earlier online application pertains to 3 survey numbers, whereas the present application is limited to S.No.117/3. He also submits that the application would be considered within three months from the date of receipt of a copy of this order. 3.Learned counsel for the petitioner has placed on record both title and revenue records. Patta No.664 stands in the name of Pappammal and the 2/4

petitioner. Therefore, it is necessary to issue notice to the joint pattadhar Pappammal before taking a decision on the petitioner's application. It is also necessary to issue notice to owners of relevant adjacent lands including the 4th and 5th respondents. In case the said respondents are able to establish that there is a dispute with regard to title, survey should not be undertaken, whereas, if such dispute is confined to boundaries, the first and second respondents may decide such dispute.

4.This writ petition is disposed of subject to the above observations by directing the first and second respondents to conduct an inquiry on the basis of the petitioner's request for survey after issuing notice to the petitioner, joint pattadhar Pappammal and the respondents herein. This process shall be concluded within three months from the date of receipt of a copy of this order. If necessary, the revenue officials may take the assistance of the jurisdictional police. No costs.
