O R D E R

This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the respondents to consider and pass orders on the petitioner's representation dated 21.09.2023, as per the provisions of the Street Vendors (Protection of livelihood Regulation) Act, 2014, made for granting permission/certificate of vending and till such time, not to disturb with the running of his petty bung shop near Aruldosspuram Water Tank, Thathaneri, Madurai-18.

2. The case of the petitioner is that he is physically challenged person having 65% disability in his leg. He is running a petty bung shop near Aruldosspuram Water Tank, Thathaneri, Madurai from the year 1991. The subordinates of the second respondent came to the petitioner's shop and disturbing the peaceful running of the said shop. Hence, the petitioner has made a representation to the respondents on 21.09.2023, to take necessary action to give permission to run the said shop in that 2/4

place. Having acknowledged the said representation, there is no response at all from the respondents. Therefore, the present writ petition has been filed.

3. The learned Standing counsel appearing for the second respondent would submit that they have not disturbed the petitioner's possession and the request of the petitioner will be considered by the authorities properly, after inspecting the said place.

4. Considering the above said submission, this Court directs the respondents to find out the said place is viable to run the petty shop or if there is any difficulty, the respondents are directed to give an alternative place to the petitioner in the nearby area to enable him to run the business.

5. With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed. 10.01.2024 akv 3/4
