Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order of the 2nd respondent in Na.Ka.No.3456/Ni/2/2020, dated 28.07.2023 and quash the same as illegal and consequently directing the respondents to grant appointment on compassionate ground to the petitioner on account of the demise of her mother Gowri, who died in harness while in service with the 2nd respondent.

ORDER

The present writ petitioner has been filed by an aspirant to Government employment on compassionate grounds challenging the order passed by the 2nd respondent herein.

2. A perusal of the impugned order indicates that without assigning any specific reasons whatsoever, the request of the petitioner for compassionate appointment has been rejected. The order being a nonspeaking order, this Court is inclined to set aside the same.

3. In view of the above said facts, the impugned order is set aside and the matter is remitted back to the file of the 2nd respondent herein to pass a detailed order, assigning reasons for the rejection of the request of the petitioner for grant of compassionate appointment. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of copy of this order.

4. With the above said observations, this Writ Petition stands allowed. No costs.
