ORDER

The petitioner is before this Court seeking a direction to the first respondent to de-freeze his Savings Bank Account No.881232937, maintained with the first respondent Bank, and permit him to operate the same.

2. The learned counsel for the petitioner submits that the petitioner's savings bank account has been unfairly frozen by the first respondent Bank at the behest of the respondents 2 and 3.

The learned Standing Counsel for the first respondent, on the other hand, submits that the account was frozen due to suspicious transactions and based on complaints received from the Sub-Inspector of Police, Thadagam Police Station, Coimbatore, and two other complaints from the Station House Officers of the Cyber Crime Police Station, Kerala, and Indirapuram Police Station, Uttar

Pradesh. The complaints pertain to suspicious transactions amounting to Rs.1,53,763/- on 19.07.2023 and a similar deposit of Rs.1,55,880/- on 20.07.2023, in respect of which, complaints have been lodged with the respondents 2 and 3.

4. Considering the above, the first respondent is directed to hold a sum of Rs.3,09,643/- [Rs.1,53,763/- + Rs.1,55,880/-] in a lien account. The said amount shall remain under lien and shall be released to the petitioner subject to the final outcome of the investigations pending against him. The first respondent is further directed to defreeze the remaining balance in the petitioner's account.
