DECREE : This Second Appeal came up for hearing on Thursday, the Ninth day of February, Two thousand and Seventeen; upon perusing the Grounds of Appeal, the Judgment and decree of the Lower Appellate Court and the Court of First instance and the material papers in the suit and upon hearing the arugments of Mr.G.Godwin, Advocate for the Appellants and of Mr.C.K.M.Appaji, Advocate for the Respondent, and having stood over for consideration till this day, this Court doth order and decree as follows :-

1) that the Judgment and decree dated 11.03.3010 made in A.S.No. 73 of 2008 on the file of the Subordinate Judge, Padmanabhapuram, reversing the Judgment and decree dated 22.08.2008 made in O.S.No.76 of 2005 on the file of the Additional District Munsif, Padmanabhapuram be and hereby are confirmed and the Second Appeal is dismissed; and
