O R D E R
This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to issue a separate patta in favour of the petitioner by measuring and demarcating the property to an extent of 731⁄2 cents (representing a 2/3 share) in Survey No. 511, which has a total extent of 1 acre and 47 cents and another property to an extent of 1 acre and 81⁄2 cents (representing a 2/3 share) in Survey No. 509, which has a total extent of 2 acres and 17 cents, including well and pathway rights in 2/6
both survey numbers, situated at Pallapatty Village, Dindigul District, based on the petitioner's representation dated 28.09.2023.
2. Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing on behalf of respondents 1 to 5.
3. The petitioner submitted a representation dated 28.09.2023 to the respondents seeking issuance of separate patta in favour of the petitioner pertaining to the properties referred to above. However, no action has been taken on the said representation. Hence, the present writ petition has been filed.
4. Learned Government Advocate, appearing on behalf of the respondents, submits that the petitioner's representation would be considered on merits and in accordance with law.
5. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent/Tahsildar to consider the petitioner's representation dated 28.09.2023 on merits and in accordance with law and to pass appropriate orders within a period of eight weeks from the 3/6
date of receipt of a copy of this order.
6. The representation shall be considered and disposed of after conducting an inquiry. The second respondent is further directed to afford a reasonable opportunity to the petitioner and to all other persons who may be affected by such decision during the course of the inquiry. There shall be no order as to costs.
