This Second Appeal is filed under Section 100 of CPC., to Set aside the Decree and Judgment passed in AS.No.45/2005 dated 31/01/2007 by the District Judge, Sivagangai reversing the Judgement and Decree dated 14/02/2005 passed in OS.No.1/2003 on the file of Subordinate Judge, Devakottai by allowing this Second Appeal with costs.

Prayer in MP(MD). 1/ 2011 in SA(MD).654/2011 : To order stay all further proceedings of the decree and judgment dated 30/01/2007 in AS.No.45/2005 passed by District Judge, Sivaganga reversing in OS.No.1/2003 on the file of the Subordinate Judge, Devakottai and thus render justice. ORDER : This Appeal having been posted for orders on this day, for not having paid the batta in the presence of Mr.S.Mahesh Babu, Advocate, for the Appellant and this Court having granted time on or before 23.02.2017 as condition precedent and the said Advocate, not having complied with the said direction of this Court, it is ordered that this Appeal do stand dismissed against the sole respondent.
