..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the first respondent to pass final orders on the retention application preferred by the petitioner dated 30.05.2025 and consequently forbear the respondents from taking any coercive action against the petitioner's building in R.S.No.97, Ward 10, Sambakulam, Madurai, pending final determination on the said retention application.

ORDER

The petitioner seeks a direction to the first respondent to pass final orders on the retention application submitted by her on 30.05.2025 and, consequently, to forbear the respondents from taking any coercive action against her building situated in R.S. No. 97, Ward 10, Sambakulam, Madurai, pending final determination of the said retention application.

2. Mr.K.Sivabalan, learned Standing Counsel takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the stage of admission itself.

3. According to the petitioner, her retention application dated 30.05.2025, along with the revised plan for the residential building, has not been considered by the respondents till date. Hence, she has filed the present writ petition.

4. The learned Standing Counsel appearing for the respondents would submit that the application of the petitioner will be considered in accordance with law.

In view of the above, without expressing any opinion on the merits of the matter, the respondents are directed to consider the petitioner's retention application dated 30.05.2025 and pass final orders on its own merits within a period of two months from the date of receipt of a copy of this order, after affording a reasonable opportunity to the petitioner. Till such time, no coercive action shall be taken by the respondents.

6. Accordingly, this Writ Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
