DECREE:- This Second Appeal coming on for hearing on this day upon perusing the Grounds of Appeal, the Judgment and Decrees of the Lower Appellate Court and the court of First instance and the material papers in the suit and upon hearing the arguments of MR.S.KADARKARAI, Advocate for the appellant, and of MR.S.SATHISH KUMAR, Additional Government Pleader, appearing on behalf of the respondents, this Court doth order and decree as follows:- i. that the Second Appeal preferred against the judgment and decree dated 26.02.2010, made in A.S.No.207 of 2005 on the file of the Sub Court, Tuticorin confirming the judgment and decree dated 06.04.2005 made in O.S.No.676 of 2004 on the file of the Principal District Munsif, Tuticorin, be and hereby is dismissed; and ii. that there be no costs.
