ORDER
This writ petition has been filed to quash the impugned order of the fourth respondent made in Ka.Number:E.Po/Udangudi/KO.Ka/Aa.A.318/2025 dated 06.09.2025 and consequential direction to the fourth respondent to provide temporary electricity connection for petitioner's application No. 200073730825644 dated 08.08.2025 in S.No.382/1A1B1B2, Udangudi Village, Tiruchendur Taluk, Thoothukudi District.

Heard the learned counsel appearing for the petitioner and Mr.S.Deenadhayalan, learned Standing Counsel, who takes notice for the respondents 1 to 4 and Mr.S.Prakash, learned Government Advocate (Crl.side), who takes notice for the fifth respondent. Since no adverse order is going to be passed against the sixth respondent, notice to him is dispensed with.
3. By consent, this writ petition is taken up for final disposal at the admission stage itself.

It is the case of the petitioner that he had applied for temporary electricity service connection to the petition mentioned land for construction of building for 'Viyabarigal Munnetra Sangam' before the fourth respondent. Thereafter, the petitioner has received a communication dated 18.08.2025 stating that the sixth respondent objected the same stating that the petition mentioned sangam was declared non functioning of society for non submission of three years accounts under provision of Section 44(3) of the Tamil Nadu Societies Registration Act 1975 and published in the Tamil Nadu Gazettee No. 43, dated 03.11.2010. Subsequently, on 04.05.2011 the said sangam was dissolved. In this regard, the petitioner had filed W.P(MD).No.20540 of 2022 to restore the registration of the society and the same is pending before this Court. On receipt of said communication, the petitioner has also sent reply 3/6
explaining the fact to the fourth respondent. However, the fourth respondent refused to provide the temporary connection vide impugned order dated 06.09.2025. Challenging the same, the petitioner is before this Court.
5. The ownership of the petitioner sangam is not in dispute as they have purchased the property as early as on 01.06.1990 under a registered sale deed. The petitioner proposes to put up a construction in this premises. The only ground on which the petition for grant of electricity connection has been rejected is on account of the fact that the registration of the petitioner's society has been revoked, that is the subject matter of the challenge in W.P(MD).No. 20540 of 2022. The petitioner now only seeks a temporary connection. Therefore, the impugned order passed by the fourth respondent in Ka.Number:E.Po/Udangudi/KO.Ka/Aa.A.318/2025 dated 06.09.2025 is hereby set aside and this Writ Petition is allowed. The respondent shall process and grant the temporary connection to the petitioner mentioned property subject to the outcome of the above stated writ petition, within a period of three weeks from the date of production of this order copy. No costs. Consequently, connected Miscellaneous petition is closed.
