O R D E R
The present writ petition has been filed seeking a mandamus as against the first respondent to issue a passport to the petitioner by considering his reply dated 10.09.2025.
2. When the petitioner made an application, he was called upon to explain by an order dated 19.08.2025 about the adverse police report touching upon Crime No.72 of 2019 and Crime No.297 of 2024. The petitioner has submitted his reply dated 10.09.2025. Even thereafter, the request for issuance of passport was not considered and hence the present writ petition has been filed.
3. A perusal of the status report filed by the second respondent shows that as far as Crime No.72 of 2019 on the file of the CSCID, Madurai, is concerned, it has been closed by the DRO Court, Madurai, by his proceedings dated 30.04.2019. As far as Crime No.297 of 2024 on the file of 2/5
the B4-Keeraithurai Police Station, is concerned, though final report is said to have been filed by the police officials, so far, it has not been taken on file and it has been returned for rectification of certain defects. The petitioner has filed a copy application before the concerned court, seeking a copy of the charge sheet and the same has been returned by the learned Judicial Magistrate No.IV, Madurai, on 10.10.2025 stating that so far charge sheet has not been filed.
4. This Court in a judgment reported in 2014 8 MLJ 61 (Mr.W.Jaihar Willam Vs.the State of Tamil Nadu) has held that mere pendency of FIR would not be a legal impediment for issuance of passport.
5. In view of the above said facts, the first respondent is directed to consider the request of the writ petitioner for issuance of passport and pass orders within a period of four weeks from the date of receipt of a copy of this order.

6. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
