ORDER
This Petition has been filed to summon the Contemnors 1 and 2/ Respondents 2 and 3 and to punish them for their wilful and disobedience of the order of this Court made in WP(MD) No.8098 of 2018 dated 04.11.2024.
2. While pending contempt petition, by order dated 23.01.2026, this Court recorded that a fresh proposal is prepared to lay the drainage water adjacent to the petitioner's land and also a site plan. It is also explained to the officer concerned of the Contemnors. He seeks time to consult with his super officer to complete the said project. Further, this Court also recorded that the petitioner is also ready and willing to share the expenses for the project to be completed by the respondents. 2/5
3. In furtherance to the said order, today (ie.13.02.2026), the first respondent filed a status report. It revealed that a joint site inspection was conducted on 20.11.2025 and 13.01.2026 and an estimate has been prepared for Rs.25,00,000/- for constructing drain to prevent the flow of rainwater into the petitioner's land for the length of 90 meters. This estimate will be submitted for getting administrative approval from the Government in the upcoming Financial Year 2026-2027.
4. In view of the above, the first respondent is directed to submit the estimate for getting administrative approval to the Government within a period of four weeks from today. The Secretary to Government, Highways Department, Government of Tamil Nadu, is directed to sanction administrative approval for the project within a period of eight weeks thereafter. It is made clear that the Secretary to Government, Highways Department, Government of Tamil Nadu, is directed to complete the project without any financial implication on the petitioner. 3/5
