O R D E R

Heard both sides.

2. The writ petitioner executed settlement deed dated 16.03.2007 in favour of his wife. It was presented for registration. Citing the objection from the third party, registration was refused. Challenging the impugned refusal check slip, this writ petition has been filed.

3. The petition-mentioned property belonged to Muthu Pandi, father of the writ petitioner. Muthu Pandi passed away. The property devolved on his six legal heirs including the writ petitioner. The other legal heirs relinquished their share in the property vide document dated 23.02.2025. It was registered as document No.848/2015. The revenue record stands in the name of the writ petitioner. Therefore, the registering authority could not have 2/4

3 W.P.(MD)NO.28817 OF 2025 refused registration by citing the objection from a third party. It is not the case of the registering authority that the objector has obtained any restraint order from the jurisdictional civil Court. In the absence of such order, the registration could not have been refused. In this view of the matter, the impugned refusal check slip is quashed. The petitioner is permitted to re-present the document and it shall be registered and released subject to fulfilment of the other usual formalities. This writ petition stands allowed. No costs.
