ORDER

The Criminal Revision is directed against the order passed in Cr.M.P.No.3246 of 2023 dated 27.06.2023 on the file of the Principal District and Sessions Court, Virudhunagar District at Srivilliputhur dismissing the petition seeking extension of time for complying with the order made in Cr.M.P.No.2597 of 2023 in C.A.No.63 of 2023 dated 24.05.2023 wherein the petitioner was directed to deposit a sum of Rs.1,06,000/- (Rupees One Lakh Six Thousand only) within one month before the trial Court.

2. The learned Sessions Judge, by observing that the petitioner has not chosen to obey the order of the said Court, that though it was stated that the petitioner was affected by Jaundice, the same was not proved by any evidence and that the reasons submitted for non-depositing the amount is not acceptable, dismissed the petition.

3. The learned counsel appearing for the petitioner would submit that the petitioner is ready to deposit some more amount as directed by this Court. 4.Considering the above facts and circumstances and taking note of the submissions of the learned counsel appearing for the petitioner, this Court is of the view that the petitioner is given one more opportunity to comply with the order of the Court. But at the same time, considering the fact that the first order came to be passed on 24.05.2023 and impugned order came to be passed on 27.06.2023, this 2/4

Court is of the view that the petitioner should be directed to deposit some more amount.

5.Hence, the petitioner is directed to deposit a sum of (*)Rs.2,25,000/- (Rupees Two Lakhs and Twenty Five Thousand only) within a period of one month from the date of receipt of a copy of this order, before the trial Court and however, the other conditions imposed by the learned Sessions Judge remain unaltered.

6.With the above direction, this Criminal Revision Case is disposed of. No costs.
