This Civil Miscellaneous Petition has been filed to set aside the order dated 28.01.2025 in C.M.P.(MD)No.12107 of 2024, which was dismissed automatically due to the non-payment of costs within the time stipulated, and to restore the same.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The learned counsel for the sole respondent has not raised any objections to this petition.

4. The learned counsel for the petitioner submitted that the delay of 224 days in filing the present restoration petition was already condoned by this Court on 10.02.2026 in C.M.P.(MD)No.18225 of 2025 in C.M.A. (MD)SR No.59965 of 2024.

5. Being satisfied with the reasons stated in the affidavit, and also considering the fact that this is only a consequential petition, this Civil Miscellaneous Petition is allowed.
