ORDER

The petitioner seeks a direction to the second respondent to file a final report in Crime No.11 of 2016, which was registered for the offences under Sections 147, 148, 294(b), 427 and 506(ii) of IPC.

2. The learned Additional Public Prosecutor, on instructions, would submit that the investigation was completed and a final report has been filed before the learned Judicial Magistrate, Kodaikanal stating that "further action is dropped"; that an RCS notice was sent to the petitioner and that the learned Judicial Magistrate before accepting the final report had issued notice to the petitioner; and that since Since the petitioner was absent, the final report was accepted.

3. The learned counsel for the petitioner disputed the receipt of any RCS notice or any notice from the learned Judicial Magistrate concerned. 2/4

4. This Court cannot entertain such a factual dispute in this petition. Hence, this Criminal Original Petition is dismissed.
