ORDER

The petitioner is the Headmaster, Correspondent and Secretary of a non-minority aided school. He has filed this writ petition as against the communication of the 2nd respondent dated 29.06.2022. 2.The 2nd respondent the Presiding Officer of the Internal Complaints Committee has communicated the 1st respondent / the District Educational Officer that they are not in a position to conclude the proceedings as contemplated under the provisions of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 in view of the non co-operation of the petitioner. 3.The case of the petitioner is that the 2nd respondent has proceeded with the enquiry without even furnishing the copy of the complaint which is mandated to be furnished to the delinquent as required under Rule 7 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules,2013. 2/5

4.This court considered the rival submissions made. 5.Sub-Rule 2 of Rule 7 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 mandates a copy of the complaint to be furnished to the delinquent and therefore, the 2nd respondent is supposed to have furnished a copy to the petitioner as provided under the Rules, 2013. Therefore, this writ petition is disposed of as follows :

i.The 2nd respondent is directed to furnish a copy of the complaint to the petitioner and to proceed with the enquiry. ii.The petitioner is directed to co-operate for the enquiry. iii.The enquiry shall be completed within a period of six weeks from the date of receipt of a copy of this order. 6.In view of the above directions, the impugned order is set aside. No costs. Consequently connected miscellaneous petitions are closed. 02.12.2025 DSK 3/5
