PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the 1st and 2nd respondents to survey of petitioner's land by metes and bounds in Survey No.194/4A2 measuring 0.5.85 Hec/ares Survey No.190/9C4A, measuring 0.22.27 Hec/ares, Kavalipatti Village, Thiruvonam Taluk, Tanjure District and also direct the 3rd and 4th respondents to provide necessary police protection at the time of such survey, based on the petitioner's representation dated 12.06.2025 within the stipulated time, that may be fixed by this court.

ORDER

By relying on patta No.2742, the petitioner had applied for conduct of survey in respect of land in S.Nos.190/1B, 190/9C4A and 194/4A1. The present writ petition relates thereto.

2.Learned counsel for the petitioner submits that the respondents did not conduct a survey inspite of the petitioner's making requisite payments for conducting the survey and for providing police protection. He also submits that there is no rival title claim, but that owners of adjacent lands have raised objections.

3.Learned Additional Government Pleader accepts notice on behalf of respondents 1 to 2 and learned Government Advocate(crl.side) accepts notice on behalf of respondents 3 and 4. After considering objections, if any, of the owners of adjacent lands, learned Additional Government Pleader submits that the survey would be conducted.

4.In these circumstances, this writ petition is disposed of on the following terms:- a)The first and second respondents are directed to issue notice to the petitioner and owners of relevant adjacent lands in relation to the request for survey. An inquiry shall be conducted by considering the objections, if any of owners of adjacent lands;

b)If such objections relate to title, the survey shall not be conducted. If the objections relate to disputed boundaries, the first and second respondents may take a decision;

c)The entire process shall be concluded within three months from the date of receipt of a copy of this order; and d) If necessary, the revenue officials may avail of the assistance of the jurisdictional police. No costs.
