ORDER
The petitioners seek to quash the final report in Spl.S.C.no.17 of 2021 on the file of the learned Special Court for the Exclusive Trial of PCR Act Cases, Sivagangai, which was filed for the offences under Sections 294(b), 323, 506(ii) of IPC and Sections 3(1)(s), 3(1)(r) of SC/ST (PoA) Act.

The allegation in the final report is that due to prior enmity, on 30.08.2021, the first petitioner asked the defacto complainant/third respondent's husband to come to Panchayath Office; that when the defacto complainant went to the Panchayath Office, the petitioners attacked the defacto complainant, abused him in filthy language and humiliated him on account of his caste and thus, committed the aforesaid offences.
3. Admittedly, the defacto complainant/victim is no more. The third respondent, who is the wife of the defacto complainant, has stated that she does not wish to pursue the impugned prosecution as against the petitioners. The 2/6
petitioners and the third respondent have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 14.10.2025.
4. The learned Additional Public Prosecutor, on instructions, would submit that the defacto complainant had received the compensation amount of Rs.25,000/- from the Aadidravidar Welfare Department.
5. The learned counsel for the third respondent would submit that the third respondent would return the said compensation amount within a period of two weeks from today.
6. The petitioners and the third respondent, namely, Valarmathi (Aadhaar No.3045 2412 0774) are present before this Court in person. They are identified by Mr.B.Saravanan, Special Sub Inspector of Police, Karaikudi North Police Station, Sivagangai District. All the parties confirmed the compromise arrived at between them.
5. In view of the same and considering the nature of the offences and since the victim/defacto complainant is no more, the wife of the defacto 3/6
complainant/third respondent does not wish to pursue the impugned proceedings, this Court is of the view that no useful purpose would be served in keeping the impugned final report pending trial. Accordingly, the impugned final report in Spl.S.C.No.17 of 2021 on the file of the learned Special Court for the Exclusive Trial of PCR Act Cases, Sivagangai, is quashed and the Criminal Original Petition stands allowed on the following conditions: (i) the petitioners shall pay a sum of Rs.25,000/- to the Mediation Centre, attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
(ii) the compensation amount received by the defacto complainant shall be returned to the Adidravidar Welfare Department, within a period of two weeks from the date of receipt of copy of this order. (iii) if the petitioner and the third respondent fail to comply with any of the conditions, the order passed by this Court shall stand vacated without further reference to this Court.
