ORDER
The Transfer Civil Miscellaneous Petition is filed to withdraw the case in H.M.O.P.No.430 of 2009, now pending on the file of the Family Court, Madurai and transfer the same to some other Court of competent jurisdiction at Madurai.
2. The petitioner/wife has come up with the transfer petition making allegations against the Presiding Officer. These allegations are made based on the hearsay I.e., the respondent/husband is informing to everybody that he has already met the Presiding Officer in-person and he will be getting favourable orders. These allegation is made only based on the mis-apprehension. A litigant should not be encouraged in making allegations against the Presiding Officer in light hearted manner. The said practice should be deprecated.
3.Further, the Transfer Civil Miscellaneous Petition is of the year 2011 and once it was dismissed on 08.04.2011 for default. Subsequently, on 21.02.2013, it was restored to file. Today also there is no representation for the petitioner. I find no merits in the allegations made by the petitioner against the Presiding Officer.
4. Accordingly, the Transfer Civil Miscellaneous Petition is dismissed. No costs.
