ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 to 3 to survey the lands in Survey Nos.110 and 112 situated at Sirumalai Village, Dindigul East Taluk, Dindigul District, and to record the 20 feet wide cart track [Vandipathai] in the revenue records for the purpose of ingress and egress to the petitioner's land in Survey No.110, Sirumalai Village, Dindigul East Taluk, Dindigul District.

2. According to the petitioner, he is the owner and in possession of the land in Survey No.110 situated at Sirumalai Village, Dindigul East Taluk, Dindigul District. It is submitted that there exists a 20 feet wide cart track [Vandipathai] running through Survey Nos.110 and 112, which has been in use for several years

as the only access for ingress and egress to the petitioner's land. However, the said cart track [Vandipathai] has not been properly surveyed and recorded in the revenue records. In spite of repeated requests, the respondents 1 to 3 have failed to conduct the survey and record the pathway. Hence, the petitioner has approached this Court seeking a direction to the respondents 1 to 3 to survey the lands and record the 20 feet wide cart track [Vandipathai] in the revenue records for the purpose of ingress and egress to the petitioner's land.

3. The learned Additional Government Pleader for the respondents 1 to 3 submitted that proper steps would be taken to demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents 2 and 3 to consider the representation of the petitioner dated 26.09.2025, demarcate the petitioner's land after considering the claims of the petitioner as well as the fourth respondent, and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed. NCC : Yes / No (K.SURENDER, J.)
