O RDER This petition has been filed seeking to direct the respondents to transfer the investigation in Crime No.165 of 2023 on the file of the third respondent Police to the second respondent or any other independent officer under the supervision of the first respondent Police based on the petitioner's representation, dated 07.12.2023

2. It is a case and counter case. The present subject matter is the Crime No.165 of 2023 and counter complaint is registered in crime No. 164 of 2023.

3. Now the grievance of the petitioner is that on the date of alleged occurrence, this petitioner was working in a Tasmac shop and CCTV footage is also available.

4. If it is so, let the petitioner appear before the third respondent and share all the information available with him. Then only, investigation may be undertaken by the third respondent on that line. Over simple issue, this petitioner is seeking transfer of investigation. It cannot be entertained.

5. Since it is a case and counter case, let both the complaints be undertaken by the third respondent jointly by following proper procedure and complete the same within a period of three months from the date of receipt of copy of this order.

6. With the above said directions, this Criminal Original Petition is disposed of.
