PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to direct the Special Court for SC/ST (Prevention of Atrocities) Act, Srivilliputhur, to accept the surrender of the Petitioner/Rank not known in connection with the Crime No.235 of 2023 on the file of the Respondent Police and to consider the Petitioner's bail application on the same day. O R D E R

The learned Counsel for the Petitioner submits that this Criminal Original Petition has been filed to direct the Special Court for SC/ST (Prevention of Atrocities) Act, Srivilliputhur, to consider the Petitioner's bail application on the same day of surrender in Crime No.235 of 2023 on the file of the 2nd Respondent.

2.The learned Government Advocate (Crl.side) submits that this is a second petition filed by the Petitioner. The first petition was already dismissed by this Court on the ground that the learned Government Advocate (Crl.side) stated that the Petitioner had two previous cases. As per the FIR, the defacto complainant was stopped and abused and the Petitioner herein is alleged to have held out threat to the life of the Petitioner. 3.It is submitted by the learned Counsel for the Petitioner that there is change of circumstances. The co-accused in this case was granted bail by the Trial Court. The learned Counsel for the Petitioner also furnished the 2/5

copy of the order granting bail to the co-accused by the learned Trial Judge by order dated 18.12.2023.

4.In the light of the fact that the co-accused had been granted bail by the Trial Court, this Criminal Original Petition is disposed of with the following conditions:- i) The Petitioner is directed to surrender before the Special Court for SC/ST (Prevention of Atrocities) Act, Srivilliputhur, within 15 days from the date of receipt of a copy of this order or from the date of uploading the copy of this order in the official web-site of this Court. ii) On such surrender by the Petitioner, the Special Court for SC/ST (Prevention of Atrocities) Act, Srivilliputhur, shall consider the bail application of the Petitioner and dispose of the same as per law, after issuing notice to the victim of crime/complainant and hearing the objections of the victim of the crime.
