Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for records in Letter No.Thani/EPF/TNSTC/NAGER/2023, dated 13.12.2023 issued by the 2nd respondent and quash the same, consequently direct the respondents to disburse the retirement benefits (i.e Employee Provident Fund, Gratuity, Earn leave) to the petitioner with 9% interest rate calculated from the date of retirement of the petitioner i.e. 01.06.2023.

ORDER

The present writ petition has been filed by a Conductor of the respondent Transport Corporation who attained superannuation on 31.05.2023 seeking to quash the order passed by the authorities wherein they have sought further time for disbursing the terminal benefits.

2. A perusal of the impugned order, dated 13.12.2023 reveals that due to paucity of funds, they are not in a position to release the terminal benefits. According to the learned counsel appearing for the petitioner, terminal benefits have not been released so far.

3. Considering the above said facts, there shall be a direction to the respondents herein to release gratuity and PF on or before 31.03.2024. The other terminal benefits shall be released on or before 31.07.2024.

4. With the above said observations, this Writ Petition stands 2/4

disposed of. No costs.
