PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for records relate to the order of the 2nd respondent in Pa. Mu.No.2776/2023/P dated 15.03.2024 and quash the same as arbitrary and illegal and in consequence to direct him to restore the Patta in the name of the petitioners, for the land the land measuring 27 cents in S.No.16/2B and 54 cents in S.No.16/3 in Kokkulappi village, Madurai West Taluk, Madurai District, now in T.S.No.14/4 and T.S.No.14/5 in Madurai 1/4
Corporation.

ORDER
An order dated 15.03.2024 of the Revenue Divisional Officer is assailed in this writ petition.
2.Learned counsel for the petitioners submits that the patta in name of the petitioners should not have been cancelled and that such cancellation is in violation of the Tamil Nadu Patta Passbook Act and the rules framed thereunder. 3.Learned Government Advocate accepts notice on behalf of the respondents 1 to 3.
4.On perusal of the impugned order, it is evident that the petitioners were heard before such order was issued and the materials submitted by the petitioners appear to have been considered. The order itself indicates the petitioner has an alternative statutory remedy by way of revision before the 2/4
District Revenue officer. In these circumstances, I am not inclined to exercise discretionary jurisdiction.
5.Accordingly, without making any observations on the merits, this writ petition is disposed of by leaving it open to the petitioners to challenge the order impugned herein before the District Revenue Officer. If an appeal is filed within 15 days from the date of receipt of a copy of this order, the District Revenue Officer is directed to receive and dispose of the same on merits without going into the question of limitation. No costs.
