ORDER

This petition has been filed to quash the impugned charge sheet in STC No.1233/2025 on the file of the learned Judicial Magistrate Court, Alangulam.

2. The case of the prosecution is that the defacto complainant, who is the trustee of 'Arulmigu Mutharamman Temple' had organized a temple festival between 02.06.2025 to 04.06.2025. On 04.06.2025, at 01:00 AM, when the celebrations were going on, the petitioner and others as one party and one Mariappan and others as the other party started quarrelling with each other by standing near the chavadi of the temple bus stop and abused each other with filthy language and were involved in a physical & verbal altercation, pushing one after the other, thereby causing great harm to public tranquillity. Thereby, the defacto complainant lodged a complaint before the first respondent police and First Information Report in Crime No.140 of 2025 was registered for the offence under section 194(2) of BNS, 2023. After investigation, the same culminated in laying STC.No.1233 of 2025 on the file of the learned Judicial Magistrate Court, Alangulam. Challenging the same, this petition has been filed.

The learned counsel for the petitioner categorically contended that, having not registered a first information report against the 'A' party, the first respondent police had registered the case against the 'B' party alone. That itself, would suffice to substantiate the fact that no affray had been committed by the petitioner herein and hence, he sought the indulgence of this Court.

4. The learned Government Advocate (Crl.Side) submitted that a careful reading of the charge sheet Itself would suffice to prove that it is a clear case of affray and sought for dismissal of the petition.

5. Even though notice has been served to the defacto complainant and his name was printed in the cause list, he has not appeared before this Court either in person nor through counsel.

6. Heard both sides and carefully perused the materials available on record.

7. A careful reading of the Charge Sheet itself reveals that three persons and the petitioner herein had indulged in fighting in a public place, namely, near the chavadi of temple bus stop and disturbing the public peace by pushing 3/5

and pulling and also indulging in physical altercation and verbal abuse. A clear overtact is made out as against the petitioner. Hence, this Court does not find any necessity to interfere with the final report, which was filed against the petitioner.

8. Accordingly, this Criminal Original Petition is dismissed. Consequently, the connected miscellaneous petitions are closed. 05.02.2026 NCC : Yes / No Index : Yes / No dss TO
