Writ Petition filed under Article 226 of the Constitution of India, praying to issue a WRIT OF MANDAMUS directing the respondents to award three marks additionally to the petitioner in connection with the direct recruitment of Sub-Inspector of Police by the 2nd respondent pursuant to the petitioners representation dated 23.2.2010 and further direct them to provide appointment to the post.

************* [Judgment of the Court was delivered by G.R.SWAMINATHAN, J.] This writ appeal is directed against the order dated 22 March 2010 allowing W.P.(MD) No.3654 of 2010 filed by the respondent herein.

2.The learned single Judge allowed the writ petition filed by the respondent herein based on the common order dated 04 Novermber 2009 passed by the Principal Bench in batch of writ petitions in W.P.No.4509 of 2009 etc.

3.The learned Additional Government Pleader appearing for the appellants submits that the said common order dated 04 Novmber 2009 made in W.P.No.4509 of 2009 etc. batch was reversed by the Division Bench in W.A.No.1719 - 1739 of 2009 etc batch on 23 February 2010. Since the order based on which the writ petition filed by the respondent was allowed itself has been reversed, this writ appeal will have to be necessarily allowed. 4.This writ appeal is allowed and the order dated 22 March 2010 made in W.P.(MD) No.3654 of 2010 is set aside.
