PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the settlement deed cancellation of document Nos.3232 of 2015, 3233 of 2015, dated 17.06.2025 and settlement deed document No.630 of 2022, dated 28.01.2022 and sale deed document No.4503 of 2022, dated 14.06.2022 on the file of the 4th respondent in light of the decision of the Hon'ble Full Bench of this Court in the case of Sasikala and others Vs. Revenue Divisional Officer cum Sub Collector, Devakottai, Sivagangai District and others, reported in (2022) 7 MLJ 1.

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the settlement deed cancellation of document Nos.3232 of 2015, 3233 of 2015, dated 17.06.2025 and settlement deed document No.630 of 2022, dated 28.01.2022 and sale deed document No.4503 of 2022, 2/5
dated 14.06.2022 on the file of the 4th respondent in light of the decision of the Hon'ble Full Bench of this Court in the case of Sasikala and others Vs. Revenue Divisional Officer cum Sub Collector, Devakottai, Sivagangai District and others, reported in (2022) 7 MLJ 1.
2.The brief facts are that the petitioner is a beneficiary of the settlement deed, dated 06.12.2013, executed by the 5th respondent Santanakumari. Subsequently, it has been cancelled on 17/06/2015. The petitioner states that he is not aware of the cancellation date. However, there is a suit in O.S.No.28 of 2016, on the file of the District Court, Ramanathapuram, filed by Santanakumari. The said suit was referred to Lok Adalat and the parties have entered into compromise. But there is no terms of compromise. It only states that the parties will settle among themselves. In the meanwhile, the said Santanakumari has sold the property to 6th respondent on 28/01/2022. In turn, she has sold the property to 7th respondent on 14/06/2022. Now, the petitioner is seeking to cancel the settlement deed and the unilateral cancellation of the settlement deed.
3.This Court is of the considered opinion that when subsequent sale has happened, the remedy to the petitioner is to file a civil suit. Therefore, the writ petition cannot be entertained. Hence, the writ petition is dismissed. No 3/5
