O R D E R

The present writ petition has been filed challenging the online status of the respondent, wherein, the request of the petitioner for issuance of Legal Heir Certificate has been rejected with a remark "application not recommended".

2. According to the learned counsel appearing for the petitioner, the petitioner's father namely, Alphones, has passed away on 04.10.2022 and she is the only legal heir. When she made an online application on 01.11.2022 seeking issuance of Legal Heir Certificate in her favour, the online status manifests that application not recommended. Hence the present writ petition has been filed.

3. According to the learned counsel appearing for the petitioner, no notice was issued to her or any enquiry was conducted before passing this order.

4. Considering the above said facts, the order impugned in the writ petition is set aside and the matter is remitted back to the file of the respondent. The respondent is directed to issue notice to the petitioner, conduct an enquiry and thereafter pass a reasoned order based upon the online application made by the petitioner.

5. With the above said observation, this Writ Petition stands allowed to the extent as stated above. There shall be no order as to costs. Consequently connected Miscellaneous Petition is closed.
