PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the respondents 2 and 3 to sub-divide and issue separate patta in the name of the petitioner and the legal heirs of his brother qua the land to an extent of 6 acres 40 cents comprised in Survey Nos.67/1 and 67/2, Madhampatti Village, Manapparai Taluk, Tiruchirappalli District on the strength of the application dated 07.12.2023 within the period that may be stipulated by this Court.

The petitioner seeks limited relief of issuance of Writ of Mandamus to direct the respondents 2 to 3 to sub-divide the petitioner's property and issue separate patta to the petitioner and the legal representatives of the his brother in respect of the lands measuring 6 acres and 40 cents comprised in Survey Nos.67/1 and 67/2, Madhampatti Village, Manapparai Taluk, Tiruchirappalli District. The petitioner has made necessary application on 07.12.2023 and the same has not been disposed of. 2/5

2.Learned Government Advocate on instructions would submit that Survey Nos.67/1 and 67/2, have been mutated in the 'A' register in the names of Kanakambigai Ammal and Arulmigu Agastheeswarar temple and therefore, the Tahsildar has already taken steps to conduct necessary enquiry and after affording an opportunity to the petitioner as well, final orders would be passed on the petitioner's application.

3.Recording the said submission, the third respondent is directed to conclude the enquiry and pass final orders in accordance with law and on merits, within a period of twelve [12] weeks from the date of receipt of a copy of this order.

4.Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
